Jesus Ponce was hired to be a warehouse supervisor. His main duties included opening  & closing the warehouse (Monday through Saturday), making schedules, supervising employees, answering phones, and performing other administrative duties.

On March 28, 2026, Jesus Ponce claims he injured his back and dropped a dumbbell on his foot. After visiting Kaiser for treatment, he was prescribed a rest period (no work) from 4/7 – 4/11.   360 Fitness Superstore paid Jesus for his time during this period.   He was then given a modified activity dispensation from Kaiser for 4/12 – 4/28.   His duties were sedentary, including making schedules, supervising employees, answering phones, and performing other administrative duties. At no time upon his return did he report any further difficulties or physical pain/discomfort.

On 4/17/26, he shared with me that he had been in a serious car accident and that he was on disability due to the injuries from the accident for an extended period before his employment at 360 Fitness. He stated that he received a settlement from the accident, but his disability pay ran out. The judge denied his subsequent claim, and it looked as if he would need to repay the extended disability payments, so he needed money. He also told me that the affected foot was disfigured and not functioning properly as a result of the aforementioned car accident, and that he had had multiple surgeries on it. He described the problems with his toes and other parts of the foot.
